The Roberts Court is Undermining the Republic

University of Texas law professor Stephen Vladeck has written a new book that outlines how since 2017, the Court has dramatically expanded its use of the out-of-the-public-eye “shadow docket,” to regularly make rulings that affect millions of Americans without public hearings and without explanation. Conservatives on the Court have used the shadow docket to green-light restrictive voting laws and bans on abortion, and to curtail immigration and COVID vaccine mandates. The book is The Shadow Docket: How the Supreme Court Uses Stealth Rulings to Amass Power and Undermine the Republic. You can buy a copy here.

Democratic Congressman Adam Schiff of California is a man with a virtual target on his back from MAGA Republicans. He was thrown off the Intelligence Committee by Speaker Kevin McCarthy. Which kind of works for him, because it gives him more time to campaign for the Senate to replace Dianne Feinstein when her term ends at the beginning of 2025. Congressman Schiff was a major player in efforts by the Congress to hold Donald Trump accountable including being Impeachment Manager on Trump's first impeachment and as Chairman of the House Intelligence Committee. He is a close ally of former Speaker Nancy Pelosi. One of his main issues right now is the “ethics’ of the Supreme Court. And he's introduced legislation to provide a binding ethics regime on the Court.

The progressive Minnesota Attorney General Keith Ellison is a man of many firsts. He's the first African American to hold a statewide elected office in Minnesota, and the first Muslim American to hold an elected statewide office in any state. A former Congressman Ellison ran for and won the Attorney General's position in 2018. In 2020, Minnesota Governor Tim Waltz asked Ellison to take over as a special prosecutor in the death of George Floyd. Ellison charged Derek Chauvin with murder and won a conviction. It is very unusual for police officers to be held criminally liable for deaths caused by them in the line of duty. Now Ellison has written a about the case and police violence, entitled Break the Wheel: Ending the Cycle of Police Violence.

The Bulwark’s Will Saletan has a new long article/short book entitled: The Corruption Of Lindsey Graham: A case study in the rise of authoritarianism. This is a very important and well-written and reported story that charts the fall of Graham from severe Trump critic to Trump enabler. He says it was a slow process for Graham and mirrors how a society descends into authoritarianism, one small step at a time. And before we realize what is happening it could be too late. Clarence Thomas: Ethical Disaster

Norm Ornstein has been studying and writing about Congress and politics for over 40 years. He is currently a Senior Emeritus Scholar at the American Enterprise Institute, a mostly conservative think tank. He wrote (along with Thomas E. Mann) It's Even Worse Than It Looks: How the American Constitutional System Collided With the New Politics of Extremism. When it came out in paperback, they changed the title to It's Even Worse Than It Was. Now he says, jokingly, if they did another edition, he might call it Run for Your Lives. This is Ornstein’s fifth appearance on The Bill Press Pod, so highly does Bill value his opinions and insights.

Donald Trump was arraigned yesterday on 34 felony counts in a New York state court. The crime was falsifying business records as part of scheme to potentially avoid taxes and to influence the outcome of the 2016 election. We caught up with New York-based reporter Hunter Walker, a longtime contributor to the Bill Press Pod. Walker literally wrote the book on the January 6th investigation along with Denver Riggleman and has followed the Trump story from the beginning. Hunter is currently an Investigative Reporter for Talking Points Memo. He was most recently a White House Correspondent for Yahoo News.
